Terms of Service

Last updated: March 2026. These Terms of Service ("Terms") govern your access to and use of the kitechain website and platform (the "Service") operated by Simon Richert and Anna Papanakli ("we", "us", or "operators"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service. Our Privacy Policy explains how we process personal data and forms part of your agreement with us where applicable law requires it.

Eligibility

The Service is intended for business and professional use. You must be at least 18 years old and have authority to bind your organisation if you use the Service on its behalf.

Description of the Service

kitechain is an AI-assisted design and advisory platform for enterprise process automation, workflow design, and agentic systems. The Service helps users describe business processes, evaluate technical feasibility, produce architecture blueprints, and obtain build guidance for tools such as Microsoft Power Automate, Copilot Studio, Azure, and third-party automation platforms.

Output from the Service is generated with the assistance of large language models and related technologies. It is intended to support planning and implementation work; it is not a substitute for professional legal, compliance, security, or engineering review.

Accounts and Access

Parts of the Service require authentication. You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information when registering or contacting us and notify us promptly of any unauthorised use.

We may restrict, suspend, or terminate access at our discretion if we reasonably believe you have violated these Terms or pose a risk to the Service or other users.

Acceptable Use

You agree not to misuse the Service. In particular, you must not:

attempt to gain unauthorised access to systems, data, or accounts; reverse engineer or scrape the Service except as permitted by law; upload unlawful, infringing, or harmful content; use the Service to develop competing models or datasets without our consent; or interfere with the operation, security, or integrity of the Service.

You are solely responsible for the business processes, data, and configurations you describe in the Service and for how you implement any recommendations in your own environments.

AI-Generated Output and Your Responsibility

Blueprints, diagrams, checklists, export packages, and other materials produced by the Service may contain errors, omissions, or outdated guidance. You must review all output before relying on it or deploying it in production systems.

You remain responsible for compliance with your organisation's policies, applicable law, vendor terms (including Microsoft and other platform providers), data protection requirements, and security standards. We do not guarantee that any design will work in your tenant, meet regulatory requirements, or achieve particular business outcomes.

Intellectual Property

The Service, including its software, branding, documentation, and visual design, is owned by the operators or their licensors and protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes in accordance with these Terms.

You retain ownership of the business content you submit. You grant us a licence to process that content solely to operate and improve the Service, including running AI models and storing session or project data where applicable.

Third-Party Platforms and Services

The Service may reference or integrate with third-party products (for example Microsoft 365, Power Platform, Azure, OpenAI, Anthropic, Supabase, or hosting providers). Your use of those products is governed by their respective terms and licences. We are not responsible for third-party availability, pricing, or conduct.

Design Partner Program

From time to time we may offer early access, pilots, or design-partner arrangements on commercial terms described separately. Unless otherwise agreed in writing, such programs are provided on an evaluation basis, may be changed or discontinued at any time, and do not constitute a commitment to future features, pricing, or service levels.

Availability and Changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Maintenance, updates, model changes, and infrastructure limits may affect performance or results. We may modify or discontinue features with reasonable notice where practicable.

Disclaimer of Warranties

The Service is provided "as is" and "as available" to the fullest extent permitted by law. We disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the extent permitted by applicable law, the operators shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, business, or goodwill, arising from or related to your use of the Service.

Our aggregate liability for claims arising from these Terms or the Service shall not exceed the amount you paid us for the Service in the twelve months preceding the claim, or EUR 100 if no fees were paid, except where liability cannot be limited under mandatory law (including under German law for injury to life, body, or health, or for fraud).

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) remain in effect.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the current version. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules. If you are a consumer with habitual residence in the EU, mandatory consumer protection provisions of your country of residence may also apply. Place of jurisdiction for merchants is, where permitted, the operators' registered place of business in Germany.

Privacy and Data Processing

Our processing of personal data is described in the Privacy Policy. Where we process personal data on behalf of your organisation, a separate data processing agreement may apply for design-partner or commercial arrangements.
